Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your access to and use of the TrackTraining platform at admin.tracktraining.co.za and related services (the "Service") provided by TrackTraining ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organisation you represent.

2. Accounts and roles

You must provide accurate information when creating an account and keep your credentials secure. The Service supports multiple roles (Admin, HR, standard users, and Super Admin). You are responsible for activity carried out under your account and for managing access within your organisation.

3. Acceptable use

You agree not to:

  • Use the Service unlawfully or to violate the rights of others.
  • Upload malicious code, attempt to breach security, or interfere with the Service.
  • Reverse engineer or copy the Service except as expressly permitted by law.
  • Use the Service to store data you are not authorised to process.

4. Customer data

Your organisation owns the data it submits to the Service ("Customer Data"). You grant us a limited, non-exclusive licence to host, process and display Customer Data solely as necessary to provide and support the Service. You are responsible for the accuracy, legality and lawful basis of Customer Data, including personal information of employees.

5. Service availability

We strive for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may perform scheduled maintenance and may modify or discontinue features with reasonable notice where practical.

6. Fees

If your plan includes fees, they are payable in accordance with the pricing communicated to your organisation. Non-payment may result in suspension or termination of access.

7. Confidentiality

Each party agrees to protect the other's confidential information using at least the same care it uses for its own confidential information and to use it only as necessary to perform under these Terms.

8. Intellectual property

We retain all rights, title and interest in and to the Service, including all related software, designs and trademarks. No rights are granted other than those expressly stated in these Terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. Compliance ultimately remains the responsibility of your organisation.

10. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues. Our aggregate liability arising out of or relating to these Terms will not exceed the fees paid by your organisation to us in the twelve months preceding the event giving rise to the claim.

11. Termination

Either party may terminate access for material breach that remains uncured after reasonable notice. On termination, your right to access the Service ends and we may delete Customer Data after a reasonable export period, subject to legal retention obligations.

12. Governing law

These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the courts of South Africa, unless otherwise required by mandatory law.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
